The series was initially intended to be picked up by Network Ten, but this fell through due to budget concerns before subscription service Foxtel commissioned a first season of ten episodes in 2003.

Pre-production lasted 18 months before filming began on 21 June 2004.

While developing the show, creators John Edwards and Claudia Karvan explored a possible spin-off series set in a hospital, featuring Karvan's character Alex and Rex (played by Vince Colosimo), but this project never came to fruition.

Much was made of the connection between Love My Way and The Secret Life of Us, since both shared star Claudia Karvan and creative talent like John Edwards, Jacqueline Perske and writer Tony McNamara, though Love My Way is not a continuation of that earlier series.

Foxtel's director of television and marketing, Brian Walsh, said the series marked the network's first freedom to produce a drama exclusively for subscribers, citing inspiration from HBO series such as Six Feet Under, The Sopranos and Sex and the City, aiming for something 'edgy, daring, provocative'.

The series was filmed on location in Sydney, including at The Sunday Telegraph office and at the infamously dangerous Cromwell Park, which was possible because the budget covered the necessary council fees.

Because it aired on pay TV, the production had freedom to push boundaries with regular swearing, drug use and sexual scenes and references, content that is typically limited on free-to-air television.

Star Claudia Karvan was also a co-producer of the series and wrote for it, while Brendan Cowell, who played Tom, worked as a scriptwriter for two episodes of season 1 and three episodes of season 2.

The original theme song by The Psychedelic Furs was covered by Magic Dirt for the series' title sequence.

Foxtel was criticised for repeatedly moving the show between channels—from Fox8 to W. Channel for season two, then to Showtime for season three—with Showtime not included in the basic subscription package in Australia.
